    Abstract

    This dissertation aims to provide a critical examination of the detention, treatment and supervision of mentally disordered individuals in the Criminal Justice System. The research will explore how this group can be more efficiently managed to ensure that health and justice goals are more effectively met. Although there are alternative solutions available it is apparent that high numbers of prisoners suffering from mental health problems are housed within prisons in England and Wales. Arguably the focus of debate surrounds the appropriateness of treatment for this group which is the care and control dichotomy which undermines the overall attentiveness which should be afforded to them. This dissertation will explore what procedures are in place by the police to initially identify someone who is suspected to have a mental disorder, and if so categorised what options are then available and what safeguards should be implemented. It will also explore what affect both police detention and prison can have on the mentally disordered individual, highlighting that in some cases incarceration can be detrimental to their health and overall wellbeing. It will explore how the unique needs of the individual can be met whilst taking into account the concerns of the public, their safety and the need to punish the offender for their wrongdoing. Finally it will propose a number of plausible alternatives to ‘mainstream’ incarceration which will satisfy the healthcare needs and a credible criminal justice response which should be afforded to this section of society.
